Recent Case Law and Legislation Affecting the Design/Build Industry
This presentation will review recent case law and legislation affecting the construction industry with an emphasis on the design/build method. Legislative topics will include laws enacted as a result of the Regular Session of the 2007 Legislature such as the new contingent payment statute, alternative project delivery methods for public civil works projects, and condominium construction defects. The presentation will also discuss recent case law addressing insurance coverage for construction defects and conditions precedent to payment from an owner.
Speaker
Anthony Whitley is an attorney in the Dallas office of Ford Nassen & Baldwin P.C. His work is focused on issues relevant to the construction industry, including contract creation, review and negotiation, mechanic's lien and bond law, alternative dispute resolution and litigation. His practice includes counseling and advising all participants in the construction industry in both the public and private sector. Mr. Whitley is a member of the State Bar of Texas and is a member of the Construction Law Sections of the State Bar of Texas, as well as the Dallas Bar Association. He is also a member of the Construction Industry Forum of the American Bar Association.
