AB 110/SB 87 The High-Speed Rail Authority shall not enter into a design build contract prior to January 1, 2012, unless it determines that there is a critical need to enter into a design-build contract prior to that date, and it provides the Joint Legislative Budget Committee with a description of the proposed contract and an explanation of the critical need at least 60 days prior to entering into such a contract, in order to permit legislative review.
AB 436 Amends Public Works Labor Compliance to read: EXISTING LAW GIVES SPECIFIED AUTHORITY FOR CERTAIN SCHOOL DISTRICT GOVERNING BOARDS, GOVERNING BOARDS OF COMMUNITY COLLEGE DISTRICTS AND COMMUNITY COLLEGE FACILITY CONSTRUCTION PROJECTS, CITIES, COUNTIES, QUALIFIED ENTITIES THAT OPERATE A WASTEWATER FACILITY, SOLID WASTE MANAGEMENT FACILITY, OR WATER RECYCLING FACILITY, TRANSIT OPERATORS, AND UNIFIED SCHOOL DISTRICTS TO ENTER INTO DESIGN-BUILD CONTRACTS FOR SPECIFIED PROJECTS IF CERTAIN REQUIREMENTS ARE MET, INCLUDING THE ESTABLISHMENT AND ENFORCEMENT OF A LABOR COMPLIANCE PROGRAM OR THE CONTRACTING WITH A 3RD PARTY TO OPERATE A LABOR COMPLIANCE PROGRAM. EXISTING LAW GIVES SPECIFIED AUTHORITY FOR THE SAN DIEGO MODEL SCHOOL DEVELOPMENT AGENCY TO AWARD CONSTRUCTION CONTRACTS, AS SPECIFIED, AND REQUIRES IT TO ESTABLISH AND ENFORCE A LABOR COMPLIANCE PROGRAM OR TO CONTRACT WITH A 3RD PARTY TO OPERATE A LABOR COMPLIANCE PROGRAM.
AB 1023 In a contract between the design-build entity and a subcontractor, and in a contract between a subcontractor and any subcontractor thereunder, the percentage of the retention proceeds withheld shall not exceed the percentage specified in the contract between the school district and the design-build entity. If the design-build entity provides written notice to any subcontractor who is not a member of the design-build entity, prior to or at the time the bid is requested, that a bond may be required and the subcontractor subsequently is unable or refuses to furnish a bond to the design-build entity, then the design-build entity may withhold retention proceeds in excess of the percentage specified in the contract between the school district and the design-build entity from any payment made by the design-build entity to the subcontractor.
SB 734 Upon approval by the authority of the small business program, its provisions shall be included in the design-build procurement for Phase 1 and Phase 2 of the high-speed rail program and in the environmental, architectural, and engineering stage for Phase 2 of the high-speed rail program.

HB 4526/SB 185 State Truckline Funds: Sec. 601. The department shall work with the road construction industry and engineering consulting community to develop performance and road construction warranties for construction contracts. The development of warranties shall include warranties on materials, workmanship, performance criteria, and design/build projects. The department will report by September 30 of each calendar year to the House of Representatives and senate appropriations subcommittees on transportation, the state budget director, and the house and senate fiscal agencies on the status of efforts to develop performance and road construction warranties.

SB 245 Relating to protection of Chesapeake Bay Watershed. The West Virginia Economic Development Authority shall expend the bond proceeds from the revenue bond issues authorized and directed by this section for projects certified under the provision of this subsection: Provided, That the bond proceeds shall be expended in accordance with the requirements and provisions of article five-a, chapter twenty-one of this code and either article twenty-two or twenty-two-a, chapter five of this code, as the case may be: Provided, however, That if the bond proceeds are expended pursuant to article twenty-two-a, chapter five of this code and if the Design-Build Board created under said article determines that the execution of a design-build contract in connection with a project is appropriate pursuant to the criteria set forth in said article and that a competitive bidding process was used in selecting the design builder and awarding the contract, the determination shall be conclusive for all purposes and shall be considered to satisfy all the requirements of said article.
