2007 Brings New Design-Build Legislation in the States

2007 is shaping up to be a very active year for design-build legislation with all 50 state legislatures meeting in session this year. Two states will carry over legislation from 2006, New Jersey and Virginia. In both states existing design-build bills introduced in 2006 will be carried over to the 2007 session. 10 additional states have introduced new design-build legislation so far in 2007. DBIA is working closely with these states and their DBIA chapters to provide resources and assistance as the bills move through the legislative process. Additional design-build legislation will be introduced in other states as they begin their legislative sessions.

California SB 56
Highway construction contracts: Design-Build Demonstration Program: transportation entities.
Iowa SSB 1008
A study bill relating to the military code by amending the powers of the adjutant general and by allowing the armory board to enter into design-build contracts for the construction of certain National Guard facilities.
Mississippi HB 227
Public projects; authorize governing authorities to use design-build method of awarding contracts.
Mississippi HB 1537
Dual phase design-build construction; provide procedure for procurement and establish procedure for construction managers at risk.
Montana HB 334
Make build-design highway program permanent

New Jersey A 967
Concerning design-build contracts and design-build-operate and maintain contracts awarded by the State or State authorities and supplementing Title 52 of the Revised Statutes.
Oklahoma SB 732
Negative bill: Public buildings and public works; deleting design-build and at-risk delivery methods in certain circumstances. Effective date. Emergency.
South Carolina S 282
A bill to authorize certain project delivery methods for state procurements relating to infrastructure facilities.

Increases from $1 million to $5 million the amount that localities may procure under a fixed price design-build basis.
