The 2002 (8th edition) of Design-Build Lessons Learned contains 45 landmark legal cases and disputes that occurred during various design-build projects in 2002. These landmark cases (dealing with issues of A/E relationships, single point of responsibility, contract formation, and copyright infringement) have established legal precedents in case law that have significantly affected the practice of design-build project delivery.
The 2003 (9th edition) of Design-Build Lessons Learned reports on 62 cases and covers a wide spectrum of design-build issues. This edition not only discusses cases from projects across industry types (including EPC, transportation and commercial), but the names of the parties will be familiar to many of you — Raytheon, Dick Corporation, ABB, Washington Group, Siemens Westinghouse and Alstom to name just a few. You will also find some incredibly important design-build questions answered by the cases from this 2003 edition, including: (a) whether the owner owns the risk of errors in its RFP documents; (b) who bears responsibility for liquidated damages in a design-build joint venture relationship; (c) whether a builder’s risk insurance policy covers design defects; and (d) how much discretion does a public agency have in selecting a design-builder.
