DBIA Legislation and Advocacy

DBIA advocates for the increased use of the design-build project delivery method for public procurement at the local, state and federal level.  While  DBIA also advocates for the increased use of the design-build in the private sector, we recognize the importance and influence of the public sector.  To raise the visibility of the design-build project delivery method at the state and local levels, DBIA works with its 14 Regions.

Strategic Policy Initiative Fund

Strategy Policy Initiative Fund logoDBIA's Strategic Policy Initiative Fund seeks to expand the advocacy outreach of the design-build industry, to promote the value of design-build and to increase public understanding of the design-build project delivery method. The Fund supports advocacy projects that DBIA would not otherwise have the resources to accomplish, such as the campaign to add qualifications-based selection for design-builders to the Federal Acquisition Regulations or sponsoring outreach workshops for owners on new state design-build laws.

2011 Notable Design-Build State Legislation Enacted

Various states successfully passed 56 bills in 2011. Please see the full list of state legislation enacted in 2011.

Congress looking to craft legislation to streamline project delivery and provide flexibility to states so they can address their infrastructure needs. Check out the article,w hich presents a great opportunity for design-build.

HI HB 985/SB 120: Authorizes stipends on design-build projects.

IN HB 3458: Amends the Park District Code; authorizes park districts to enter into design-build contracts; defines design-build; specifies the solicitation process for design-build proposals; sets forth the requirements for the award of design-build contracts; provides that park districts must use a two-phase procedure for the selection of the successful design-build entity for projects where the budgeted construction cost is over a specified sum; requires evaluations of total project costs.

LA HB 182: Extends the length of time relative to the utilization of design-build contracts to July 10, 2015.

MO SB 173/HB 430: The Missouri State Transportation Commission's design-build authority extends from 2012-2018. It is authorized to use design-build for construction/reconstruction of the US 40/61, I-64 bridge. Metropolitan (St. Louis/St. Louis County) sewer districts are authorized to use design-build for projects that exceed $1 million.

NY SB 2A: Relates to enacting into law major components of law necessary to the state; relates to personal income tax rates, the metropolitan commuter transportation mobility tax, in-state manufacturer taxation; a youth works tax credit, a jobs retention program, the use of design-build on infrastructure, hurricane and storm relief, school district property tax collection, the New York City Transit Authority funds diversion, and project labor agreements under NY-SUNY 2020 Challenge Grant Program.

NY SB 2808: New York Budget Bill authorizing all state universities to use design-build.

OH HB 114: Ohio Bill authorizes ODOT to (1) enter into P3 agreements; (2) increased spending authority on design-build projects from $250 million per biennium to $1 billion annually; (3) authorized “best value” on design-build projects; and (4) allows stipends on design-build projects.

TX HB 628: Authorizes all state agencies except the DOT and Institutes of Higher Learning; local government, counties, school districts and any other special district commission to use any procurement method that provides the best value, including design-build and CM at Risk. This statute does not apply to highways, roads, bridges, underground utility, water/waste water, wharf, dock or other civil engineering construction.

TX SB 1420: Authorized design-build for non-toll highway projects.

UT SB 86: Utah bill extends the design-build sunset on transportation projects from 7/2011 to 7/2015

UT SB 155: Utah bill authorizes first-class cities to decrease the minimum threshold for design-build projects from $50 million to $20 million.

VA HB 1609: Virginia bill extending design-build authority to Metro planning authorities with a population in excess of 80,000.

VA HB 2520: Virginia bill deleting the $1.5 million minimum requirement on design-build projects and eliminating the requirement for localities of 100,000 to get approval from the design-build review board.

WV HB 2861/SB 282: West Virginia bill continuing the pilot highway design-build program.
